ИМПЛЕМЕНТАЦИЯ НОРМ МЕЖДУНАРОДНОГО ВОДНОГО ПРАВА ВВОДНОМ КОДЕКСЕ УЗБЕКИСТАНА: ВЫЗОВЫ И ПУТИСОВЕРШЕНСТВОВАНИЯ

Данная статья посвящена анализу имплементации норм
международного водного права в новом Водном кодексе
Республики Узбекистан (ЗРУ-1076 от 30.07.2025 г.).
Рассматривается соответствие Кодекса принципам Конвенции
ООН о несудоходных водотоках 1997 г. и Конвенции Эспо 1991 г.
Отмечается, что статьи 157 и 158 закрепляют принципы
справедливого и разумного использования водных ресурсов и
предотвращения трансграничного вреда, однако их
практическая реализация затрудняется отсутствием чётких
процедурных механизмов. На примере проекта Рогунской ГЭС
показана необходимость обязательной оценки трансграничного
воздействия. В статье предлагается совершенствование
подзаконных актов и разработка трансграничного
имплементационного стандарта.
